Yeah, Let’s Waterboard Terrorists

In the wake of the murder of a Kansas doctor who performed abortions by a pro-life zealot, isn’t it hypocritical that the same people who screamed about William Ayers being a domestic terrorist and attacked Obama for “palling around” with him don’t think of people who kill doctors or bomb medical facilities as domestic terrorists? Including Sarah Palin.

Personally, I think we should waterboard the murderer. I’m sure we can establish a link between him and Iraq, but just in case, we should have Dick Cheney waterboarded too — Jesse Ventura has offered to do it.

Conservative Movie Reality

It was bad enough when Republican candidates in the presidential election invoked Jack Bauer from the TV show 24 as their model for how to deal with terrorists.

Now the National Review has published an incredibly surreal list of the “Best Conservative Movies of the Last 25 Years“. Here’s the complete list:

Their #1 Conservative movie of the last 25 years is The Lives of Others, a German film that is ironically about the evils of government wiretapping.

Other movies on their list are equally interesting. They picked #10 Ghostbusters because the bad guy (not counting the ghosts) is an obnoxious bureaucrat who works for the EPA. And how #24 Team America: World Police by South Park creators Trey Parker and Matt Stone, and Brazil by Terry Gilliam (from Monty Python) got onto their list is a mystery.

UPDATE: Fark has the complete list, along with the conservative review of each movie from NRO. I love some of their comments — Brazil is “Vividly depicting the miserable results of elitist utopian schemes”. In The Cronicles of Narnia “The White Witch runs a godless, oppressive, paranoid regime that hates Santa Claus”. And in The Dark Knight, Batman represents none other than Dubya, whose “stubborn integrity kept the nation safe and turned the tide of war” against the terrorist Joker — by devising new means of surveillance, pushing the limits of the law, and accepting the hatred of the press and public. I kid you not.

Rove doesn’t let facts get in the way of a smear

Karl Rove on Fox News‘ “On the Record”, May 26th:

We know from her record on the 2nd Court of Appeals that she’s not a particularly effective colleague. I first got wind of this when Sam Alito, who was her colleague on the court while we were reviewing his record, it — you know, people who were familiar with the workings of the court said that she was combative, opinionated, argumentative, and as a result, was not able to sort of help create a consensus opinion on important issues.

There are two problems with this. First, it is another example of using anonymous sources to smear someone. But the real problem is that Justice Alito never served on the 2nd U.S. Circuit Court of Appeals (he served on the 3rd Circuit). Kinda makes you wonder who is making up these rumors.

What really scares me about the Bush/Cheney/Rove Administration is that they got away with all their political crap despite the fact that in many ways they were unbelievably incompetent. Can you imagine the damage that could be done by an administration that was both politically adept and competent?

Conservatives decide they haven’t been obnoxious enough

Quotes from conservative G. Gordon Liddy on his radio show:

I understand that they found out today that Miss Sotomayor is a member of La Raza, which means in illegal alien, “the race.” And that should not surprise anyone because she’s already on record with a number of racist comments.

And, as if calling the Spanish language “illegal alien” isn’t bad enough, Liddy decides to piss off women, too:

Let’s hope that the key conferences aren’t when she’s menstruating or something, or just before she’s going to menstruate. That would really be bad. Lord knows what we would get then.

Is Sotomayor an “Activist Judge”?

One of the complaints that conservatives like to throw at judges they don’t like is that they are “activist judges” who “legislate from the bench”. They seem to use it as an all-purpose insult, even when it doesn’t apply. An excellent example of this is Obama’s nominee to the Supreme Court, Sonia Sotomayor.

When conservatives call Sotomayor an “judicial activist” they are simply ignoring the facts. And there are plenty of facts to chose to ignore. SCOTUSblog has an excellent review of Sotomayor’s opinions as an appellate court judge, from which a clear picture emerges of someone who is anything but a judicial activist.

In just one of the examples, a voting rights case in 2006, Sotomayor wrote in her opinion:

The duty of a judge is to follow the law, not to question its plain terms. I do not believe that Congress wishes us to disregard the plain language of any statute or to invent exceptions to the statutes it has created. … But even if Congress had doubts about the wisdom of subjecting felony disenfranchisement laws to the results test of § 2, I trust that Congress would prefer to make any needed changes itself, rather than have courts do so for it.

I have already noted that the case conservatives protest the loudest about, Ricci v. DeStefano, involving reverse discrimination against white firefighters, Sotomayor was clearly following the law. But that doesn’t stop Rush Limbaugh from howling:

[Sotomayor] ruled against the white firefighter – Ricci and other white firefighters – just on the basis that she thought women and minorities should be given a preference because of their skin color and because of the history of discrimination in the past. The law was totally disregarded.

Let’s ignore the fact that this case had nothing to do with women at all. According to PolitiFact, the unanimous “ruling by the three-judge panel makes no mention of giving preferential treatment to women or minorities”. In addition, they state:

The first thing we note is that the opinion cites numerous other cases to back up various points. That alone weakens Limbaugh’s claim that “the law was totally disregarded.”

The opinion itself states that “the Board, in refusing to validate the exams, was simply trying to fulfill its obligations under Title VII when confronted with test results that had a disproportionate racial impact, its actions were protected.” In other words, Title VII (a law) specifically prohibits the board against claims of reverse discrimination.

If conservatives don’t like that law, they should work to get it changed, not protest when a judge doesn’t change it for them. It is the height of hypocrisy to call someone an activist judge and then protest loudly when they don’t legislate from the bench.

UPDATE: Here’s an article by Geoffrey Stone (a law professor at the University of Chicago, which is one of the most prestigious and conservative law schools in the country) on the “Hypocrisy of ‘Conservative’ Critics”. Stone makes the point that conservatives who claim that they don’t want activist judges are betrayed by their actions.

What the conservatives commentators really want in a Justice … is not judicial passivism but judicial activism. What they want is not strict construction, but free-wheeling, activist interpretation … which is exactly what they’ve gotten from Justices Rehnquist, Roberts, Scalia, Thomas and Alito. What they want is conservative activism – the aggressive use of judicial power in order to smuggle conservative political views into the interpretation of the Constitution.

Dubya — self-styled tool of God

OMG! Bush actually believed all that crap about the rapture!

It turns out that Bush told the French President Jacques Chirac an involved story about the biblical creatures Gog and Magog at work in the Middle East, and how war in Iraq was “willed by God”. This was revealed by Chirac himself in a new book. Chirac was “stupefied and disturbed” by the story.

Bush also told the Palestinian foreign minister that he was on “a mission from God” in launching the invasions of Iraq and Afghanistan and was receiving commands from the Lord.

UPDATE: A reader points out that The Onion (as usual) solves the mystery of how Dubya received “commands from the Lord” — White House transcripts reveal it was actually Cheney speaking over the White House intercom.

Conservatism and Stupidity

From a new study:

Conservatism and cognitive ability are negatively correlated. The evidence is based on 1254 community college students and 1600 foreign students seeking entry to United States’ universities. At the individual level of analysis, conservatism scores correlate negatively with SAT, Vocabulary, and Analogy test scores. At the national level of analysis, conservatism scores correlate negatively with measures of education (e.g., gross enrollment at primary, secondary, and tertiary levels) and performance on mathematics and reading assessments from the PISA (Programme for International Student Assessment) project. They also correlate with components of the Failed States Index and several other measures of economic and political development of nations. Conservatism scores have higher correlations with economic and political measures than estimated IQ scores.

In other words, if you have low cognitive ability, a low SAT score, poor vocabulary, less than average education, are lacking in math or reading skills, or live in a place with a bad economy or politics, then you’re probably a conservative.

Relatively Minor Readjustments In Certain Favorable Policy Areas

Whether you agree with them or not, you gotta love The Onion:

In a slight shift from his campaign trail promise, President Obama announced Monday that his administration’s message of “Change” has been modified to the somewhat more restrained slogan “Relatively Minor Readjustments in Certain Favorable Policy Areas.” “Today, Americans face a great many challenges, and I hear your desperate calls for barely measurable and largely symbolic improvements in the status quo,” said Obama, who vowed never to waver in his fight for every last infinitesimal nudge forward on the controversial issues of torture and the military ban on homosexuals. “Remember: Yes we can, if by that you mean tiptoeing around potentially unpopular decisions that could alienate a large segment of the populace.” Washington insiders said that, while the new mottos are certainly in keeping with Obama’s pledge of government transparency, they are significantly less catchy.
